Montenegro Court Overturns Do Kwon Extradition on Appeal

The Appellate Court of Montenegro announced the acceptance of the appeal on February 7th, annulling the previous ruling made by the High Court in Podgorica. The case will now be sent back to the first instance court for retrial and a new decision. The Appellate Court stated that the previous extradition decision had significant violations of criminal procedure, citing unclear and incomprehensible wording as the reason for its cancellation.
This latest ruling regarding Kwon’s extradition is another development in the ongoing process following the collapse of Terra in May 2022. Financial regulators in South Korea and the United States accuse Terraform Labs and Kwon of orchestrating a massive fraudulent scheme, resulting in substantial losses for investors. Kwon was apprehended in Montenegro in March 2023 while trying to leave the country using falsified travel documents. Kwon is wanted not only in South Korea but also in the United States.
Previously, the Appellate Court had canceled the approval for Kwon’s extradition to either the United States or South Korea in December 2023, arguing that the final decision should be made by Montenegro’s minister of justice. In recent news related to the Terra saga, the former chief financial officer of Terraform Labs, Han Chang-joon, was extradited from Montenegro to South Korea on February 5th. In his trial for fraud in South Korea, co-founder Shin Hyun-Seong, also known as Daniel Shin, blamed the collapse of Terraform on “external attacks carried out by Do-hyung Kwon.”
